TERMS AND CONDITIONS
I - GENERAL
1) These general conditions regulate the sale, including registration, ordering and access to PAPEL&CA products offered by PEDRO DELERUE, UNIPESSOAL, LDA, with NIF 515 531 251, registered in PORTO with the same number, with headquarters at Rua Professor Bento de Jesus Caraça, 23, Porto municipality, on the website www.papelca.pt and apply to all purchase and sale contracts for PAPEL&CA products concluded between Pedro Delerue, Unipessoal, Lda and any user who places orders through the website www.papelca.pt.
2) For the purposes of these general conditions, the following definitions apply:
a) "Pedro Delerue, Unipessoal, Lda" - The entity holding all copyrights or related rights, as well as other rights that may be subject to protection provided for in the Industrial Property Code, over the website with the aforementioned address and supplier of goods available for order on the same site;
b) "User" - Any natural person, not a merchant, who places an order through the website www.papelca.pt.
3) These general conditions do not override the User's rights and guarantees set forth in the legislation in force for contracts of this nature.
II – ACCEPTANCE
1) The conclusion of purchase and sale contracts for PAPEL&CA products implies the User's knowledge and acceptance of the General Conditions.
2) By accepting the General Conditions, the User confirms having read the General Conditions, having legal capacity to accept them and to conclude the purchase and sale contract for PAPEL&CA products.
III – REGISTRATION
1) When placing an order, the User can use a previously created account or create an account during the checkout process, by filling in the fields on the website www.papelca.pt.
2) After registering as a customer, the User can access their personal online account by logging in, after entering a personal and non-transferable password, chosen by them, at the time of registration.
3) From the moment they access their personal online account, the User is subject to these general conditions, as well as the legal and regulatory rules that govern its operation and use.
IV - PAPEL&CA PRODUCTS
1) The website www.papelca.pt is aimed at users of PAPEL&CA products who wish to purchase, from their home or workplace and 24 hours a day, 7 days a week, PAPEL&CA products.
2) Information about the essential characteristics of PAPEL&CA products can be found at www.papelca.pt.
3) PAPEL&CA reserves the right to modify, at any time, the information, the offer of PAPEL&CA products, prices, promotions and commercial conditions, presented on the website www.papelca.pt.
V - REQUESTS/ORDERS
1) After accessing their personal account created on the website www.papelca.pt, the User may proceed with the online purchase of PAPEL&CA products, by following these steps:
a) Selection, through the search icons or menus, of the desired product(s) by the User;
b) Addition of the selected product(s) to the User's "Shopping Cart";
c) Registration of the User's personal data, with the option of integrating them into the PAPEL&CA database under the terms provided in the General Conditions;
d) Indication of the "Delivery Location", "Billing Location" and "Payment Method";
2) PAPEL&CA will provide all purchase details through the website www.papelca.pt allowing for the identification and correction of any errors and will request acceptance of the terms and conditions of the purchase, as well as the General Conditions;
3) The User will be informed of the status of their request/order by receiving an email message, regarding the "Order Confirmation", and a second message, after payment validation, regarding the "Order Dispatch".
4) Finally, the User's request/order will be delivered by the logistics operator to the "Delivery Location" indicated in the purchase process and with the respective detailed invoice at the address indicated by the user.
5) The placement of an online order for products included in the "Shopping Cart" implies the acceptance of their purchase, at the prices and under the terms described on the website, by the User, and the User can only place orders through the website www.papelca.pt with the prices, terms and conditions advertised therein.
6) In the event that PAPEL&CA, for any reason, does not accept the User's request, a right that PAPEL&CA expressly reserves, the User will be informed of this fact.
7) The fulfillment of all orders placed on the aforementioned website is subject to the availability of PAPEL&CA, which will try to ensure that all products offered for sale on the site are in stock. However, PAPEL&CA reserves the right not to accept any orders or cancel already confirmed orders for products for which there is no stock, in which case PAPEL&CA will inform the User of this fact and refund the amount received.
8) PAPEL&CA will not accept order requests for which one of the following situations occurs:
a) The total value of the order is greater than €1,000.00 (one thousand euros);
b) The product is not available in the PAPEL&CA warehouse (in which case the User will not be able to add the product to the "Shopping Cart");
c) Payment is not made using any of the payment options available on the website www.papelca.pt
d) Payment is not confirmed.
VI – PRICES
1) All prices for PAPEL&CA products indicated on the website www.papelca.pt include Value Added Tax (VAT), at a rate of 23% or at the rate that, at any time, results from the legal provisions of the countries in force. The total VAT payable by the User will be indicated on the invoice to be sent to the User.
2) The prices of PAPEL&CA products, as well as their characteristics, are subject to change, without prior notice from PAPEL&CA. Nevertheless, the said changes will be disclosed on the website www.papelca.pt with the aim of keeping users informed, and it is understood that the User was aware of them before placing the order.
3) If there is any error in the price of the requested products, both PAPEL&CA and the User may, at any time, until the products are dispatched, cancel the order request.
4) Prices are always subject to final validation and according to the invoice issued for the purchase.
VII - PAYMENT METHODS AND SECURITY
1) To promote the privacy and security of documents and information to be transmitted over the internet, the User can make payments for their purchases through the payment management entity, Paypal, MBWay, Multibanco reference and Shopify payments.
2) For this purpose, Paypal will provide payment by Paypal reference or credit card (Visa, Master Card) and whose conditions and terms regarding the Credit Card are available at the time of consultation/payment.
3) Payments made by MB Way or Multibanco are processed through Lusopay. For Multibanco payments, the customer will receive the Multibanco references by email.
4) Payments through the Shopify payments platform.
5) PAPEL&CA will cancel the order if it is not paid within a maximum of 48 hours.
VIII - DELIVERY COSTS
Delivery costs vary according to the following:
Mainland Portugal: €5.00 for orders under €50.00
Rest of Europe: €15.00 for orders under €100.00
IX - DELIVERY
1) PAPEL&CA dispatches the product or products ordered by the User, from Monday to Friday, with the exception of holidays and on the days and times used by the logistics company, to the address indicated by the User at the time of order confirmation.
2) PAPEL&CA undertakes to fulfill the order within a maximum of 1 to 5 working days (mainland Portugal) from the day of payment validation.
3) PAPEL&CA will inform the User of the unavailability of the ordered product or products, as well as refund the amounts paid for such product or products, within a maximum of 1 to 5 working days from the date of knowledge of such unavailability.
4) PAPEL&CA's response capacity within the aforementioned deadlines is, however, dependent on its stock availability.
5) The order is considered dispatched from the moment PAPEL&CA hands it over to the carrier, and the latter will be responsible for its delivery to the User, under the terms mentioned below:
- The products will be sent and delivered to the User by the carrier, and the latter is responsible for any delay in the delivery of the order.
- If no one is found to receive and sign the confirmation at the "Delivery Location", the logistics operator will not deliver any product.
- Delivery times may be longer than usual during festive seasons such as Black Friday and Christmas.
X – RETURNS AND CANCELLATIONS
Order cancellation before dispatch:
1) If the User places an order and wishes to cancel it, they must contact us immediately via email PAPELCA@PAPELCA.pt with their name and order number. Only after this procedure is it possible to cancel the order. The cancellation request will be analyzed, but we do not guarantee that immediate cancellation will be possible, as orders can be processed and dispatched in a short period of time, sometimes within the hour following confirmation. If the cancellation request is accepted, the User will be notified by email and the cancellation will be carried out without costs.
Return of defective products:
1) The User has the right to return the delivered product(s) if they are found to have defects or other non-conformities with respect to the ordered products, and the return must be made within 15 days of receiving the order. This does not affect your statutory rights. The User must send the product(s), in their original packaging, to the address: Papel&Ca, Rua Professor Bento de Jesus Caraça, 23, 4200-130 Porto, Portugal. You must identify with your name and order number. If your claim is justified, the price paid for the product, as well as shipping costs, will be refunded. Proof of shipment must be sent to the email: PAPELCA@PAPELCA.PT
Product Returns:
1) The User may return the ordered product(s) within 15 days of receipt, provided that:
a) The products have not been used,
b) The product maintains its original characteristics and intact labels;
2) The expenses resulting from the return of the order will be borne by the Customer.
3) Once the returned product is received, PAPEL&CA will analyze and confirm its state of preservation and, where applicable, will refund the amount paid by the User within a maximum of 30 (thirty) days without any expenses for the User.
4) If the returned items are damaged or opened, PAPEL&CA reserves the right not to accept the return and, consequently, to refuse the refund.
XI – COMPLAINTS
For any complaint regarding the contract concluded with PAPEL&CA, Users may contact:

PAPEL&CA provides the Electronic Complaints Book on its website.
XII - EXCLUSION AND LIMITATION OF LIABILITY
1) PAPEL&CA does not guarantee the permanent availability of this service www.papelca.pt and, in particular, will not be liable for damages, resulting, directly or indirectly, from the use or impossibility of use, for any reason, of the aforementioned website, namely in case of unavailability of access, technical problems or errors in data transfer telematic networks, external intrusion or presence of computer viruses, nor will it assume any responsibility for technical problems that may occur in computer equipment used during connection to the internet through the said site.
2) PAPEL&CA will also not assume any responsibility for any damages, arising, directly or indirectly, from situations of force majeure, understood as any event beyond the will or control of PAPEL&CA that prevents it, totally or partially, permanently or temporarily, from fulfilling its obligations, namely, strikes, power outages, failures in telecommunications services or any other services, fires, floods, impossibility of obtaining products, materials or services, breakdowns, delays of suppliers or carriers and changes in legislation or administrative regulations.
3) PAPEL&CA is not responsible for any abusive use of the User's access data to the site by third parties, which data are personal and non-transferable.
XIII - MODIFICATION OF THE GENERAL CONDITIONS
PAPEL&CA reserves the right to change, at any time, these General Conditions, after notification, which will be deemed to have been made by publishing the modified General Conditions on the website www.papelca.pt.
XIV - PERSONAL DATA
1) The User authorizes the collection and computerized processing of their personal data by PAPEL&CA, including all data disclosed at the time of registration on the website www.papelca.pt.
2) The data provided by the User are intended for registration on the website www.papelca.pt for access control and for the formation, execution and management of purchase and sale contracts for PAPEL&CA products.
3) The controller of personal data is PAPEL&CA and such data may also be accessed by PAPEL&CA service providers, namely accounting and auditing firms.
4) The User may, at any time, exercise the right to access and rectify their data, in the "Login" area of the website www.papelca.pt
5) The User authorizes the collection of their personal data and their computerized processing in order to allow the sending of orders and the execution of administrative operations related to them, including their monitoring and the provision of information to the User, also aiming at the preparation of statistical studies, promotional activities and direct marketing by PAPEL&CA.
6) The User is informed that the online store PAPEL&CA is hosted by Shopify, and that Shopify may process their personal data whenever they visit or make purchases in the store, including for the provision of services based on their interactions with other merchants and with Shopify itself. User information may be shared with Shopify and with third parties located in other countries, in order to enable the provision of services, including those that use data resulting from the User's interactions with other merchants and with Shopify. It is recommended to consult Shopify's Terms of Service and Privacy Policy, available at Shopify Legal - Shopify for more information on the processing of personal data carried out by this entity.
XV – DURATION
1) These general conditions apply as long as goods are supplied through the website www.papelca.pt.
2) The provisions of the preceding paragraph do not prejudice the possibility of subsequent review and/or alteration of these conditions.
3) The declaration of nullity of one or more general conditions does not preclude the application of the others, nor does it imply the invalidity of the concluded transaction.
XVI - PROOF AND ARCHIVE
1) The computer records, kept in PAPEL&CA's computer systems, are considered proof of the conclusion of the contract between the parties, as well as the conditions under which it was concluded.
2) The archive of documents proving orders and associated invoices will be carried out on a reliable and durable medium.
XVII - APPLICABLE LAW AND JURISDICTION
1) These General Conditions are subject to Portuguese Law.
2) Any questions or disputes arising from these General Conditions or from the contracts to which they apply or are part, namely regarding their validity, effectiveness, interpretation, integration, application or compliance, will be submitted to the exclusive jurisdiction of the Court of the District of Porto, with express waiver of any other.
XVIII - ALTERNATIVE DISPUTE RESOLUTION
In the event of disputes initiated by a consumer against PAPEL&CA concerning contractual obligations resulting from sales contracts or service provision, concluded between PAPEL&CA and consumers residing in Portugal, the consumer may resort to a Consumer Dispute Resolution Entity.
